Projects of Legal Guide

Legal Guide Non-Governmental organization was established in 2004. Legal Guide implements its aims by conducting relevant programs and initiatives in the field of the European and Domestic Human Rights Protection. The projects implemented by Legal Guide can be divided into two areas: Educational resources on European and Domestic Human Rights protection mechanisms and litigation before the European Court of Human Rights. Since 2002 there have been implemented the following projects and measures by the members of Legal Guide

Projects on Educational Resources on European and Domestic Human Rights protection mechanisms

Project Title:

“Interactive Human Rights” European Law Mooting Competition project – (IHR).

Project Description:

Legal Guide started cooperation with the Youth For Achievements NGO to implement the “Interactive Human Rights” European Law Mooting Competition project – (IHR). The first IHR project was launched in 2004. The Project has been and is funded by European Union. European Law Mooting Competition project aims at assisting to promote the knowledge and understanding of undergraduate, graduate and post-graduate students majoring in law, international relations, international law, political science and history on the European protection mechanisms of human rights. The Project gives an opportunity to students to be involved in mooting of a hypothetical case before the European Court of Human Rights. Legal Guide is responsible for developing the hypothetical cases of the Competition. Each time the cases are developed with consideration of timely issues and/or most frequently violated human rights and/or freedoms in the Republic of Armenia. Project Title:

Trainings on "Promoting Compliance of the European Convention of Human Rights in Armenia".

 

Project Terms:

June - December 2002

Project Description:

This project was a follow up of the Training of Trainers (ToT) Project on Promoting compliance of European Convention on Human Rights in Armenia, Georgia and Azerbaijan initiated and implemented by the British East-West Centre (BEWC) and was implemented by two Key Trainers trained within the framework of the ToT. The Training was conducted with the same methodology as the ToT for the Key Trainers. The Trainings were on Articles 2 (Right to life), 3 (Prohibition of torture), 5 (Right to liberty and security), 6 (Right to a fair trial), 8 (Right to respect for private and family life), 9 (Freedom of thought, conscience and religion), 10 (Freedom of expression) and Article 1 of Protocol No: 1 (Protection of property) to the European Convention on Human Rights. In total 13 young lawyers and advocates were trained during the Trainings in Armenia, most of who then became involved in taking cases to the European Court of Human Rights.

Project Title:

Training on Promoting ECHR Compliance in Armenia: Training for the Regions supported by the British Embassy in Armenia.

 

Project Terms:

September 2004-January 2005

 

Project Description:

The Project had been primarily focused on the cities outside of Yerevan i.e. Vanadzor and Gavar and was aimed at promoting the rule of law in the Republic of Armenia by facilitating effective application of the norms of the European Convention on Human Rights at the domestic level, mainly to the Marzes of Armenia, through the Training of lawyers, advocates, law professors and other legal professionals, including law students and teachers of human rights of the secondary schools. As a result of Trainings implemented in Vanadzor and Gavar cities in total 42 lawyers, law professors, advocates, teachers of human rights and advanced law students were trained in the theory and practice on ECHR and the compliance of the Armenian legislation to the norms of ECHR. Participants gained theoretical knowledge and practical experience of applying the norms and standards to case scenarios.

Project Title:

Representing ethnic Armenians before the European Court of Human Rights forcibly displaced from their homes in Azerbaijan and certain Armenian territories controlled by Azerbaijan

Project Terms:

2006 -2007

Project Description: 

In 2006 -2007 Legal Guide submitted around 510 new cases to the European Court of Human Rights. 302 applications out of those 510 cases were submitted to the European Court on behalf of the Applicants who fled from the territory of the Republic of Azerbaijan, including cities of Baku, sheik and other places and 208 applications were submitted on behalf of the Applicants from the Village of Artsvashen. The Applications mainly concern the following:

  • the enforced displacement of ethnic Armenians from their homes in Azerbaijan and certain Armenian territories which are currently under Azerbaijani control;

  • the illegal occupation of property belonging to these people and the failure of the Government of Azerbaijan to ensure the safety, return of property or provide relevant compensation to the applicants;

  • in some cases applications also concern the alleged violation of Art. 6 ECHR where the applicants’ claims concerning violations of their property and other rights that were submitted to judicial authorities in Azerbaijan have not been examined.

In 2008-2009 the Government of Azerbaijan and the Applicants in cases Sargsyan v Azerbaijan (No. 40167/06) and Arakelyan v Azerbaijan (No. 13465/07) were invited to submit written observations on the admissibility and merits of these cases. The Government of Armenia is participating in these cases as a third party on the basis that the applicants are Armenian nationals.

 

Project Title:

Litigation before the European Court of Human Rights

Project Terms:

September 2002- till the present

Project Description: 

Since September 2002 members of Legal Guide have been involved in litigation activities before the European Court of Human Rights. Within the frame of the mentioned activities there were submitted more than 15 applications to European Court of Human Rights. The cases mainly include alleged violations of articles 5 (Right to liberty and security), 6 (Right to a fair trial), 8 (Right to respect for private and family life), 10 (Freedom of expression), 11 (Freedom of assembly and association), 13 (Right to an effective remedy) and 14 (Prohibition of discrimination).
