The European Court has declared admissible the Case of Sargsyan v Azerbaijan

On 14 December 2011 the Grand Chamber of the European Court of Human Rights (ECtHR) passed an admissibility decision on the case of Sargsyan v. Azerbaijan (No. 40167/06). Mr. Minas Sargsyan, who was forcibly displaced by Azeries from his home in Gyulistan, region of Shahumyan in 1992, died in 2009. His case is continued by his widow and children and they are represented before the ECtHR by “Legal Guide” NGO and the European Human Rights Advocacy Center (EHRAC).

With its admissibility decision the Court found that Mr. Sargsyan’s complaints related to the alleged breaches of his rights to property and private and family life, to an effective remedy and not to be discriminated against, raised serious issues of facts and law under the Convention, and therefore required an examination on the merits. The Court declared admissble all complaints of the Applicant, with the exception of the applicant’s complaint concerning the alleged destruction of Armenian graves in Azerbaijan in general. It is expected that the merits of the case will be decided in the nearest future.
